The government through the Ministry of Transportation (Kemenhub) issued a regulation that four-wheeled vehicles must be equipped with a light fire extinguisher (APAR). This regulation was enacted on August 24, 2021 and promulgated on August 30, 2021.
In this regulation, the mandatory requirement for APAR is explained in article 2 paragraphs 1 and 2, then article 3 paragraph 3 letter b, and article 30 paragraph 1 and paragraph 2 letter b point 1.
Article 2 paragraph 1 and paragraph 2 letter b explains "Every Motorized Vehicle operated on the road must fulfill technical requirements, namely safety equipment."
Then, in article 30 paragraph 1, it is stated that "Emergency Response Facilities as referred to in Article 3 paragraph (3) letter b must be installed and equipped on Bus Cars, Passenger Cars, Goods Cars, Passenger Car platforms, and Goods Car platforms".
Then, in article 30 paragraph 2 letter b point 1, "Emergency Response Facilities as referred to in paragraph (1) in the form of a Light Fire Extinguisher" are explained.
So, when fire extinguisher regulation will implemented to society ?
According to Article 45 of the Regulation of the Minister of Transportation of the Republic of Indonesia Number PM 74 of 2021 Concerning Motor Vehicle Safety Equipment:
"This Ministerial Regulation shall come into force on the date of promulgation, so that everyone may know it, ordering the promulgation of this Ministerial Regulation by placing it in the State Gazette of the Republic of Indonesia." According to the article.
his means that starting from August 30, 2021, every four-wheeled vehicle or more is required to have a fire extinguisher.
Furthermore, in article 34 paragraph 1, the need for fire extinguishers in vehicles is divided into categories:
1. MI in the form of Passenger Cars, at least 1 (one) piece
2. Nl, N2, N3, 01, 02, 03 and 04 in the form of Goods Cars, at least 1 (one) piece and
3. M2 and M3 in the form of Bus Cars, at least 2 (two) pieces.
With fire extinguisher specifications that can extinguish solid objects (A), liquid or gas objects (B), and electrical installations with voltage (C). Of course, the extinguishing agent used must be non-toxic.
Talking about the use of fire extinguisher, Business Development Manager of PT Servvo Fire Indonesia, Hendra Prasetyo said that people should realize that APAR is very important in vehicles. Because APAR is very effective in preventing fires from spreading.
"Fire extinguisher in the car is very important, because when there is an indication of a fire we can quickly prevent the fire from spreading. If for example we wait for the fire truck to come, it takes them 15 minutes to get to the location of the fire. with that much time, surely all parts of the car must have been burned. So to prevent that, the car really needs at least 1 fire extinguisher," Hendra said some time ago.
Penalties for vehicle owners who do not carry fire extinguishers
As a first aid device, the existence of fire extinguisher has also been regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation (LLAJ). Article 57 paragraph (3) of the LLAJ Law describes a number of equipment that must be in a four-wheeled vehicle. Among them are first aid equipment in traffic accidents.
The penalty is then stated for vehicle owners who do not carry equipment that is required in every car under the same law.
"Everyone who drives a Motorized Vehicle with four or more wheels on the Road that is not equipped with equipment in the form of spare tires, safety triangles, jacks, wheel openers, and first aid equipment in an accident as referred to in Article 57 paragraph (3) shall be punished with a maximum imprisonment of one month or a maximum fine of Rp250,000.00 (two hundred and fifty thousand rupiah)," according to Article 278.
